Flipping San Diego Foreclosures

Buying and selling foreclosure properties can mean quick profits. Foreclosed homes in San Diego and throughout the U.S. are typically sold at prices from 15% to 40% below market value. So buying foreclosures can bring instant equity to a real estate investment. The amount of the discount depends upon the nature and timing of the purchase. But opportunities to invest, fix and flip foreclosed houses, town homes, and condos exist at every step of the process.

Foreclosed homes in San Diego can be purchased at trustees sales. These are auctions that are held on the steps of the county courthouse. Buyers at foreclosure auctions can realize the greatest savings and upside potential. But the auction process is generally too risky and cumbersome for individual home owners. Typical buyers at trustee sales are investment companies and partnerships that intend to fix and flip the homes at a profit. Buyers must be prepared to thoroughly investigate the condition of the properties prior to the auction, and monitor the properties right up to the time that the gavel falls. And payment at the auctions must be made by cashier checks at the close of the auction. This requires a degree of liquidity that most individuals do not have.

Investors who buy homes at San Diego foreclosure auctions frequently intend to make improvements to the property and offer the homes for immediate resale. But there are potential pitfalls to avoid with flipping properties. First, even if a buyer is willing to buy at the new price, appraisers may be skeptical of the higher sale price. A low appraisal can make it impossible for the next buyer to get a loan. So the listing agent of the property must be prepared with information to support the higher value. Data on recent sales of comparable homes as well as receipts for improvements to the property prior to the flip are critical in this regard.

Also in regard to the new buyer's loan, it makes a difference whether the new loan is conventional (20% down payment) or an FHA loan. Until recently, it was nearly impossible for a buyer to get an FHA loan on a property that had been purchased at foreclosure and flipped in less than 90 days. More recent FHA guidelines allow short-term flips, but competent handling by an experienced loan officer is important. For properties that are being flipped in less than 90 days, questions include: 1) As a flip, was it a true conversion with structural, internal repairs, and upgrades, or was it merely a "coat of paint" conversion? 2) Is the agreed upon purchase price more than 20% greater than the investor's purchase value? 3) Has the property been bought/sold more than once during the 90-day period?

For FHA loans on properties that are being flipped in less than 90 days, if the purchase price is 20% or higher than the prior purchase price, FHA will require two appraisals by FHA appraisers. FHA will also require a home inspection by an FHA inspector selected by the lender (not by the buyer). If there has been more than one sale/purchase in the 90-day period, the FHA is unlikely to approve the loan. Otherwise, subject to the two satisfactory FHA appraisals and the FHA physical inspection, an FHA loan is likely to be approved.

San Diego houses are always in demand, but some times are better than others to buy and sell houses in San Diego. No matter what the real estate market conditions, there is a seasonal component to keep in mind. Specifically, the fourth quarter of every year presents the best opportunities to match serious buyers with serious sellers of San Diego real estate.

This graph examines Carmel Valley houses listed and sold in the past three years. Carmel Valley is a popular neighborhood with great schools. Of all the San Diego neighborhoods, sales of homes in Carmel Valley are always in high demand. So as far as seasonality is concerned, Carmel Valley presents a conservative picture of similar phenomena in other Southern California neighborhoods.

The graph above shows homes sold in Carmel Valley over the past three years. Notice how there is a predictable pattern of fewer sales in the fourth quarter and first quarter of every year. Remember that the sales that close in any given month are contracts that are written 30 to 60 days prior. In other words, and offer that is presented in November will close in December or January. And an offer that is written in December will close in January or February. The graph clearly shows that fewer buyers write contracts in the fourth quarter of every year.

Now look at the number of homes listed for sale in Carmel Valley during the same timeframe:

Every year, the majority of sellers list their homes for sale in Carmel Valley during the first and second quarter. The fewest homes are listed for sale during the fourth quarter.

So as a Seller, when is the best time to sell a home in San Diego? It may be counter-intuitive, but the fact is that you're better off selling in the Fall and Winter. Waiting until Spring means that your home will face stiff competition from similar homes listed for sale in the area. During the Fall, a house that is in good condition will immediately attract attention from serious buyers. With fewer homes on the market, your home will be more likely to stand out.

And if you are considering buying a home in San Diego, when is the best time to buy? The statistics show that fewer buyers are competing to buy homes during the fourth quarter. With less competition, it is easier to find homes and actually make a purchase. Buying a home in the Spring and Summer is loaded with frustration because everyone and their brother is looking to buy a house at that same time. Less competition means better opportunity to succeed with your goal of home ownership.

Foreclosure Homes In San Diego Update

San Diego foreclosures have been a huge source of activity for the San Diego real estate market. Recent reports show an average of 30 to 40 percent homes sold in the region as foreclosure properties. But the number of foreclosures in San Diego County has actually declined in 2010 by about 5%. And the number of foreclosure homes for sale in San Diego dropped by 20.88% in the nine months ending September 2010, compared to the same period in 2009. So what’s going on?

First, banks have received considerable pressure to rework mortgages for distressed home owners rather than proceed directly to foreclosure. This has been true since the beginning of the Obama Administration. It took nearly two years, but banks have definitely made an effort to modify mortgages, and their systems have become more streamlined in the past year. San Diego foreclosures are definitely less frequent than they otherwise would have been.

Second, the number of San Diego foreclosure homes for sale has lagged behind the actual number of foreclosures. This disparity reflects the “shadow inventory” of foreclosures in San Diego and throughout the United States. Many banks decided that it makes more sense for them to hold onto a portion of their foreclosed properties rather than immediately bring them to market. Analysts predict that prices will rise in the intermediate term (the median price of San Diego homes has already increased by about 5% in the past 12 months). So the banks in many cases decided that it is better to hold on to the properties in hopes of selling at a higher price in the future.

Third, there are rumors that there will be an increase of foreclosures properties for sale in San Diego County starting around November 15, 2010. This is just a rumor, but possibly more credible than rumors in the recent past. Several banks have been calling the REO listing agents around town and telling them to staff up for the coming release of foreclosure listings.

But on the other side of the coin, the news in the past week is that there is again pressure from Washington D.C. to implement another moratorium on foreclosures. This is in response to allegations that some banks have been “rubber stamping” foreclosure documents, resulting in some foreclosure actions against mortgage holders who are current on their loan payments. Bank of America is the only large bank in California to voluntarily implement a moratorium until their administrative processing issues have been resolved. It remains to be seen whether other banks will voluntarily follow suit, or whether another moratorium will be mandated from the Federal Government.

Carmel Valley Homes In San Diego CA Top School District

Almost every home buyer relocating to San Diego asks at one time or another: "What is the best public school district in San Diego." Of course, not everyone cares, buy everyone should. Buying a house in a good school district is a great strategy for making a safe a real estate investment. Even if you don't have children of school age, when you go to sell a home the market of prospective buyers is much larger in good school districts. It is a simple axiom that higher demand supports higher real estate prices.

In San Diego, the San Dieguito Union High School District has earned a reputation for solid performance. Torrey Pines High School in Carmel Valley is one of the top performers in all of California. It is a big school, with more than 2,500 students who come from Carmel Valley, Del Mar, Solana Beach, and Rancho Santa Fe. All of these are affluent neighborhoods with parents who take pride in supporting their children and their local schools. And, as expected, house prices in these neighborhoods are also well above average.

Do "New Homes" Buyers Need Realtor Representation???

During my career as a San Diego Realtor, I've seen a lot of home buyers get burned by new home builders. An inexperienced home buyer alone at the builder's sales office is like a lamb at a wolfs' picnic. The buyer doesn't stand a chance. It's sad, yet completely avoidable. But most home buyers, and too many Realtors, don't know or enforce their rights to receive or to give representation during the new homes sale process.

First, many home buyers assume that they will save money if they go it alone with their new home purchase. What they don't realize is that the home builder almost always offers to pay real estate fees to the buyer's agent. This real estate agency fee or "broker co-op" is assumed in the developer's budget. The buyer won't pay more, but the builder will net more, if there is no buyer's agent involved. There is no additional cost for the new home buyer to have proper representation.

Second, a common builder sales approach is to tell the buyer that their homes sale prices are not negotiable. "So it won't do you any good to have an agent represent you in the transaction," the builder's agent at the sales office will say. This is simply untrue. Few if any home sellers, new homes builders or otherwise, won't negotiate. Sale prices, upgrades, financing incentives, choice of home sites, timing, and other options are all negotiable; especially in today's market.

Third, many builders of new San Diego homes for sale blatantly attempt to turn buyers' agents away. For example, the sign-in cards at the new home developments often state "Buyer's broker must accompany buyer on the first visit to the sales office" in order to receive compensation from the builder. In an era when most buyers do their initial research online with Realtor-provided access to MLS listings, this "first visit" rule catches many buyers off guard. There should be nothing wrong with a buyer driving around to check out properties before bringing their Realtor into the picture. And a buyer who steps into the new homes sales office without their Realtor should not be prohibited from having representation.

Realtors and home buyers should know how to address this "first visit" issue when it arises. The San Diego MLS (SANDICOR) rules state that any property that is listed on the MLS with an offer of compensation to a buyer's broker is a "blanket unilateral contractual offer." That offer of compensation cannot be modified our avoided by any "conditions precedent" or by requiring any performance, activity, or event as a condition of compensation (Sandicor Rule 7.12). A new home builder policy to refuse to pay agents who don't accompany their client on the first visit is a "condition precedent." It's a violation of MLS rules, and it can be challenged by the agent. Check your local MLS rules for a similar provision against conditions precedent.

Some builders think they can avoid the "condition precedent" rule through a technicality. When there are multiple homes for sale in a development, the builder will list a property address in the MLS that is not actually "for sale" (i.e. the model home). Then when the buyer puts in a deposit for a future home site, the builder will argue that the future home site was not listed in the MLS, therefore is not subject to MLS rules. I would encourage agents to file arbitration against any MLS participant who makes that argument. An arbitration panel of Realtors, many of whom have been shut out by new home builders in the past, would likely find in favor of the agent. Even the threat of arbitration or litigation would likely cause the home builder to buckle and pay the commission. So don't just walk away from representing a client who falls into the "first visit" trap.

Finally, it is unfortunate that some buyers' agents look at compensation from a new home developer as a "referral fee" rather than compensation for buyers' agency. The new home builders encourage this misconception by buyers' agents. "Just sign them in, you'll get paid, and we'll take it from here." That's the typical greeting received by buyers' agents who accompany a client to the new home sales office. Don't do it! If the agent accepts compensation, then the agent should also provide service. If something goes wrong and the buyer becomes disgruntled, I would not want to be the agent who took the money and ran. Chances are that you'll end up paying that money back... and then some.

As buyers' agents, our clients depend upon us to help them buy a home, whether it is a new home or resale. With new home purchases, a qualified agent who is a skilled negotiator can save the client thousands of dollars on the purchase and get upgrades and options that the client would not otherwise receive. There are also contingencies, disclosures, escrow documents, title policies, and other important items to review and explain to the client. Many of these documents are drafted by the builder, containing language that is clearly in the builder's favor and to the detriment of the home buyer. Without an agent to help, how would an inexperienced buyer know which contracts are standard and which are created exclusively for the builder's benefit? There are simply too many places for the client to go wrong. A new home buyer will always appreciate having their agent at their side to represent them. New home buyers beware, and buyer's agents be aware!

San Diego House For Sale, Ocean View Lot, Price Reduced Almost 25%

A very dear client called me to help sell a house in San Diego. After talking about the property, I learned that he was facing a delay due to title issues. His attorneys were working to get it cleared up. I suggested that we wait to put it on the market, until he was actually able to close escrow. But the client decided that he really wanted it to be on the market, and perhaps a buyer would want to rent before closing escrow. Not a good idea, I thought. Renting to a buyer prior to close of escrow is usually a recipe for disaster. But the client wanted to get it on the market to "test the waters."

This is a great house, near downtown San Diego. It is on a low traffic street and has a large back yard. From the yard you can see the Coronado Bridge and watch sunsets over the ocean. Inside is clean and move-in ready.

Through April we had several very strong offers. Unfortunately none of those buyers would wait until the Seller cleared up the title questions. Now the Seller says sell now! So my recommendation? Drop the price to get offers! Now priced at $229,000, down from the original list price of $300,000! This is a great deal for some lucky San Diego home buyer.
